MAK Luxury Charters Terms & Conditions
(Last Updated: August 2026)

These Terms & Conditions apply to bookings and services provided by MAK Luxury Charters Pty Ltd (“MAK Luxury Charters”, “MAK”, “we”, “us” or “our”).

By making a booking, paying a deposit or booking fee, accepting a quotation, or travelling in a vehicle arranged by MAK Luxury Charters, you acknowledge that you have read and accepted these Terms & Conditions.

1. Booking Acceptance & Confirmation

All online, telephone and email booking requests are subject to availability and final confirmation by MAK Luxury Charters.

Submitting a booking request, quotation request or payment does not by itself guarantee vehicle availability.

A booking is considered confirmed once MAK Luxury Charters has accepted the booking and issued a booking confirmation.

Customers are responsible for checking their booking confirmation and advising us promptly of any incorrect information, including dates, times, addresses, flight details, passenger numbers, luggage requirements and vehicle requirements.

2. Quotations & Pricing

Unless otherwise stated, quotations are based on the information provided by the customer at the time of enquiry.

Changes to the itinerary, pickup or drop-off location, passenger numbers, vehicle requirements, waiting time, travel duration or other booking details may result in a change to the quoted price.

Additional charges may also apply for services including, but not limited to:

  • Additional waiting time or overtime;
  • Additional stops or itinerary changes;
  • Parking, tolls or entry charges where not included in the quotation;
  • Public holiday services;
  • Services between 11:01 pm and 3:59 am;
  • Special events;
  • Cleaning or vehicle damage;
  • Additional kilometres or extended hire;
  • Last-minute booking amendments; and
  • Other services requested beyond the original confirmed booking.

Where reasonably practicable, additional charges will be communicated to the customer before being incurred.

3. Payment Terms

Unless otherwise agreed in writing, all bookings must be paid in full before the service takes place.

For weddings, tours, events and other specialised bookings, a deposit or booking fee may be required to secure vehicles and dates.

For tours, unless otherwise specified:

  • A 50% deposit may be required to confirm the booking; and
  • The remaining balance is payable no later than 7 days before the tour.

 

MAK Luxury Charters accepts payment by:

  • EFT / bank transfer;
  • Visa;
  • Mastercard; and
  • American Express.

 

Credit card and other payment processing fees may apply where permitted by law and will be disclosed where applicable.

Please include your booking confirmation number as the payment reference.

A booking may not be considered fully paid until cleared funds have been received.

5. Deposits & Booking Fees

Certain reservations require a non-refundable booking fee or deposit to reserve vehicles, chauffeurs and the requested date.

Unless otherwise specified in the quotation or booking confirmation:

  • Weddings may require a $300 booking fee; and
  • Other specialised bookings may require a deposit of up to 50% of the total booking value.

 

Different deposit requirements may apply to major events, large groups, multiple-vehicle bookings, tours and other specialised services.

Any non-refundable amount will be identified to the customer when the booking is made and remains subject to rights and remedies available under Australian Consumer Law.

6. Cancellations — Weddings

Wedding transport involves reserving vehicles and chauffeurs well in advance and may prevent MAK Luxury Charters from accepting other bookings.

Unless otherwise specified in your booking confirmation:

More than 12 months before the wedding: Any amount paid above the applicable booking fee/deposit will generally be refundable.

Between 6 and 12 months before the wedding: Up to 50% of amounts paid above the applicable booking fee/deposit may be refundable.

Less than 6 months before the wedding: Payments may be non-refundable and the outstanding contracted balance may remain payable, subject to applicable law and the circumstances of the cancellation.

Booking fees/deposits identified as non-refundable are generally not refundable for a customer-initiated cancellation, except where otherwise required by law.

7. Cancellations — Tours

Unless otherwise specified:

60 days or more before departure: Amounts paid may be refunded less any disclosed booking fee and non-recoverable expenses already incurred.

31–59 days before departure: Where the booking has been paid in full, the balance may be refunded less the applicable deposit/booking fee and non-recoverable expenses.

30 days or less before departure: Payments may be non-refundable and outstanding contracted amounts may remain payable, subject to applicable law and the circumstances of the cancellation.

We strongly recommend appropriate travel insurance for tours and significant travel arrangements.

8. Cancellations — Standard Charters & Transfers

Unless otherwise stated in your booking confirmation:

30 days or more before the service: Amounts paid may be refunded less any applicable booking fee and non-recoverable expenses.

8–29 days before the service: Where applicable, the balance may be refunded less the booking fee/deposit and non-recoverable expenses.

7 days or less before the service: Payments may be non-refundable and outstanding contracted amounts may remain payable, subject to applicable law and the circumstances of the cancellation.

All cancellations must be made in writing or by email and acknowledged by MAK Luxury Charters.

9. Booking Changes

We understand that travel arrangements can change and will make reasonable efforts to accommodate amendments.

Changes to:

  • Dates;
  • Pickup times;
  • Pickup/drop-off locations;
  • Vehicle type;
  • Passenger numbers;
  • Itineraries; or
  • Other significant booking requirements

 

may be subject to availability and may result in an additional charge.

An administration fee of approximately $30–$50 may apply to significant booking amendments where disclosed and reasonably incurred.

10. Customer Delays & Waiting Time

Customers should be ready to depart at the confirmed pickup time.

For non-airport bookings, a complimentary grace period of up to 15 minutes may be provided where operationally possible.

After the applicable complimentary waiting period, waiting/overtime may be charged at $1.50 per minute, per vehicle, unless a different rate is stated on your booking confirmation.

Additional waiting is subject to chauffeur and vehicle availability. Where excessive delay would materially affect another confirmed booking, MAK Luxury Charters may be unable to extend the service.

11. Airport Transfers & Flight Delays

Where accurate flight details have been supplied, MAK Luxury Charters will make reasonable efforts to monitor the flight and adjust the chauffeur’s arrival accordingly.

Unless otherwise stated, airport transfers generally include:

Domestic arrivals: Up to 30 minutes complimentary waiting time.

International arrivals: Up to 60 minutes complimentary waiting time.

Waiting time is calculated from the flight’s actual recorded arrival/landing time or as otherwise stated in your booking confirmation.

After the complimentary waiting period, additional waiting may be charged at $1.50 per minute, per vehicle.

Customers experiencing significant immigration, customs, baggage or other delays should contact us as soon as possible.

12. Chauffeur Arrival & Grace Period

Our chauffeurs aim to arrive before the scheduled pickup time wherever reasonably possible.

Traffic congestion, road closures, accidents, weather and other circumstances outside our reasonable control can occasionally cause delays.

A chauffeur arriving within 10 minutes of the scheduled pickup time will generally be regarded as being within our operational grace period.

Where a material delay attributable to MAK Luxury Charters occurs, we will work with the customer to provide an appropriate remedy having regard to the circumstances and applicable consumer law.

13. Vehicle Substitution

While every reasonable effort will be made to provide the vehicle specifically booked, circumstances such as mechanical failure, accident, safety concerns or other unforeseen operational issues may occasionally make this impossible.

Where this occurs, MAK Luxury Charters may provide a comparable or upgraded replacement vehicle where reasonably available.

Where a suitable replacement cannot be provided, we will work with the customer to provide an appropriate remedy in accordance with applicable law.

14. Passenger Numbers & Vehicle Capacity

Passenger numbers must not exceed the legal seating capacity of the vehicle.

The practical passenger capacity may be lower depending on:

  • Luggage;
  • Child restraints;
  • Mobility equipment;
  • Passenger comfort requirements; and
  • Other equipment being transported.

 

MAK Luxury Charters and its chauffeurs will not carry passengers in excess of the vehicle’s legal capacity.

15. Luggage

Customers must advise us of significant luggage requirements when making the booking.

All luggage must be capable of being transported safely and securely.

Luggage must not obstruct the chauffeur, doors, emergency exits or seatbelts and cannot be carried in a manner that creates a safety risk.

Oversized items including surfboards, bicycles, skis, snowboards or unusually large luggage must be disclosed before booking.

A trailer or larger vehicle may be required and additional charges may apply.

16. Alcohol

Alcohol consumption is only permitted where it is lawful for the particular vehicle and service and has been expressly approved by MAK Luxury Charters in advance.

Customers must request approval before the day of travel.

Approval is not guaranteed and may be withdrawn where required for safety, legal or operational reasons.

The chauffeur has the right to refuse or discontinue alcohol consumption where passenger behaviour, safety, vehicle cleanliness or legal requirements become a concern.

Any spillage or resulting damage may incur cleaning and/or repair charges.

17. Food, Smoking & Vaping

Unless specifically approved in advance:

Food and chewing gum are not permitted inside MAK Luxury Charters vehicles.

Takeaway food should not be brought into vehicles, including food contained in takeaway bags or containers, unless prior approval has been provided.

Wedding food and other special requirements may be accommodated by prior arrangement.

Smoking and vaping are strictly prohibited inside our vehicles.

Passengers are also requested not to smoke immediately beside open vehicle doors or windows.

18. Passenger Behaviour & Safety

All passengers are expected to behave respectfully toward chauffeurs, other passengers, members of the public and MAK Luxury Charters property.

MAK Luxury Charters may refuse to commence or may discontinue a service where a passenger:

  • Is excessively intoxicated;
  • Acts aggressively or threateningly;
  • Abuses or harasses a chauffeur or another passenger;
  • Creates a safety risk;
  • Damages or threatens to damage the vehicle;
  • Refuses a reasonable safety instruction; or
  • Engages in unlawful or seriously disruptive behaviour.

 

Where a service is terminated because of serious passenger misconduct, refunds may not be available to the extent permitted by law.

The chauffeur’s reasonable decision regarding immediate vehicle and passenger safety must be respected.

19. Cleaning & Damage

The person making the booking is responsible, to the extent permitted by law, for reasonable cleaning and repair costs resulting from damage or excessive soiling caused by themselves or members of their travelling party.

Indicative minimum specialist cleaning charges include:

  • Wine, champagne, beer or premixed alcohol spillages: from $250;
  • Smoking-related deodorisation: from $500;
  • Vomit, bodily fluids, cosmetics or chewing gum: from $750.

 

Where actual professional cleaning, repair, replacement, vehicle downtime or other reasonable costs exceed these amounts, additional charges may apply.

Where practical, supporting information regarding significant charges can be provided upon request.

20. Child Seats & Restraints

Customers must advise MAK Luxury Charters at the time of booking if a child restraint is required.

The age of the child and any relevant requirements should be provided so that an appropriate arrangement can be made.

Child restraints are subject to availability and additional charges may apply.

Passengers must use seatbelts and child restraints as required by applicable law.

21. Special Events, Public Holidays & After-Hours Services

Additional charges may apply for:

  • Public holidays;
  • Major sporting or entertainment events;
  • New Year’s Eve and other peak-demand periods;
  • Services operating between 11:01 pm and 3:59 am;
  • Large events requiring multiple vehicles; and
  • Other periods of unusually high demand.

Any applicable surcharge should be included in the quotation or otherwise communicated before confirmation where reasonably practicable.

22. Credit Card Authority & Additional Charges

Where a customer provides a credit or debit card for payment, MAK Luxury Charters may request authority to securely retain the payment method for outstanding or subsequently incurred booking charges.

Additional legitimate charges may include agreed waiting time, overtime, approved booking changes, cleaning, damage, parking, tolls or other charges arising from the booked service.

Where possible, MAK Luxury Charters will notify the customer of material additional charges and provide details of the reason for the charge.

Nothing in this clause limits the customer’s rights to question or dispute a charge.

23. Payment Default

Amounts must be paid by the due date shown on the invoice or booking confirmation.

If an account remains overdue, MAK Luxury Charters may contact the customer and take reasonable steps to recover the outstanding amount.

Where permitted by law, reasonable third-party debt recovery costs actually incurred as a result of an unpaid account may be recoverable from the customer.

MAK Luxury Charters reserves the right to decline future bookings where previous accounts remain unpaid.

24. Lost Property

Passengers are responsible for checking that they have collected their personal belongings when leaving the vehicle.

MAK Luxury Charters will make reasonable efforts to locate and return property left in a vehicle but cannot guarantee recovery of lost items.

Courier, postage or chauffeur delivery costs associated with returning lost property may be charged to the customer.

25. Social Media, Photography & Privacy

From time to time, photographs or video may be taken in connection with weddings, events or other services.

Where MAK Luxury Charters wishes to use identifiable images of customers for marketing or social media purposes, customers may request that their image not be used.

Customers may opt out by notifying us by email.

Where a customer subsequently raises a reasonable concern regarding an image published by MAK Luxury Charters, we will consider requests to remove or hide the content.

26. Third-Party & Affiliate Vehicles

To provide broader coverage and additional vehicle capacity, MAK Luxury Charters may occasionally arrange services using trusted affiliate chauffeurs or transport providers.

Where an affiliate is used, MAK Luxury Charters will make reasonable efforts to engage appropriately authorised and suitable providers and vehicles for the requested service.

Vehicle makes, models and specifications may vary from photographs displayed on our website where an affiliate or substitute vehicle is required.

27. Unforeseen Circumstances

MAK Luxury Charters will take reasonable care in providing its services.

However, travel can be affected by circumstances outside our reasonable control, including:

  • Severe traffic congestion;
  • Road closures;
  • Accidents;
  • Extreme weather;
  • Flight disruptions;
  • Police or emergency incidents;
  • Mechanical breakdown;
  • Illness;
  • Natural disasters; and
  • Other events that could not reasonably have been anticipated or avoided.

 

Where such circumstances occur, we will make reasonable efforts to minimise disruption and, where appropriate, arrange an alternative vehicle or service.

28. Liability & Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

To the extent permitted by law, MAK Luxury Charters will not be responsible for indirect or consequential losses arising from circumstances outside our reasonable control.

Any limitation or exclusion contained in these Terms & Conditions applies only to the extent permitted by law.

29. Customer Responsibility

Customers are responsible for providing accurate booking information and allowing sufficient travel time for flights, appointments, events and other time-sensitive commitments.

While MAK Luxury Charters may provide general guidance regarding travel times, customers remain responsible for selecting an appropriate pickup time having regard to traffic, airport requirements and other foreseeable delays.

30. Website & Online Booking Information

Photographs and descriptions of vehicles on the MAK Luxury Charters website are provided as a general representation of our fleet and services.

Specific vehicles are subject to availability.

Vehicle specifications, colours, features and luggage capacities may vary between individual vehicles, replacement vehicles and affiliate vehicles.

31. Privacy

Personal information supplied in connection with a booking will be handled in accordance with applicable privacy laws and MAK Luxury Charters’ Privacy Policy.

Information may be provided to chauffeurs, affiliate operators and service providers where reasonably necessary to arrange and complete the customer’s transport.

Payment card information will be handled through the applicable secure payment systems and procedures.

32. Governing Law

These Terms & Conditions are governed by the laws applicable in Western Australia, Australia.

Nothing in this clause restricts any rights a customer may have under applicable Australian consumer legislation.

By confirming a booking with MAK Luxury Charters, you acknowledge that you have read and accepted these Terms & Conditions, subject always to your rights under applicable Australian law.
